Return policy

1. Pursuant to art. 5 DL 185/1999, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to liviosport.it of Gardenia Srl a VAT number), he/she has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in point 3 below.

2. To exercise this right, the customer must request it within 10 working days of receipt of the goods. In order to request and make the return in the right way, the customer must follow the instructions at the bottom of this page regarding our RMA (Return Material Authorization) procedure.

Once the customer has made the request to one of our Customer Services, the latter can reserve the right to refuse the return request in the event that the return conditions are not met. In the event that the return request is approved, our Customer Service will contact the customer to give instructions on how to return the goods that must be returned within 48 hours.

3. The right of withdrawal is however subject to the following conditions:

the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;

the purchased good must be intact and returned in the original packaging, complete in all its parts; to limit damage to the original packaging, we recommend, when possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly to the original product packaging should be avoided;

by law, the shipping costs for returning the goods are charged to the customer;

the shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the customer; liviosport.it will notify the customer of the incident (within the fifth day of receipt of the goods in their warehouses), to allow him to promptly file a complaint against the courier and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, at the same time cancelling the request for withdrawal;

liviosport.it of Gardenia S.r.l. is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;

upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and/or the original packaging are damaged, liviosport.it di Gardenia S.r.l. will deduct a percentage from the reimbursement due, in any case not exceeding 10% of the same, as a contribution to the restoration costs.

4. Without prejudice to any repair costs for damage to the original packaging, Livio Sport will reimburse the customer for the amount of the goods excluding transport as soon as possible.

5. The right of withdrawal is totally lost, due to lack of the essential integrity of the goods (packaging and/or its contents), in cases where it is ascertained: the lack of the external packaging and/or the original internal packaging;
the absence of integral elements of the product (eg information note for sunglasses, certificate of authenticity where applicable, glasses case, ...);
damage to the product for reasons other than its transport.
In case of forfeiture of the right of withdrawal, Livio Sport will return the purchased good to the sender, charging the shipping costs to the sender.

Return policy in non-EU countries

We speak to all customers who live outside the European Union.
For each export, therefore for each of your purchases, you will be required to pay duties and taxes when the parcel arrives at the customs office in your country. Our DHL courier will contact you before delivering the goods. Customs charges must be paid by the customer.

Any tax charges or import duties are beyond our control and will eventually be invoiced directly by the courier. For more information about the amount of these charges, we recommend that you contact your local customs authorities before purchasing, so as not to be surprised by charges you were not expecting.

In the event of a return, regardless of the reason for the return, the customer will be responsible for all postage, return shipping costs, customs fees and any other charges. These costs will be deducted from the refund due.
